Welcome to Pawfleet.

The terms “we”, “us” and “our” refer to Pawfleet, operated by Miguel Mota Leon.

Pawfleet operates this online store and website, including all related information, content, features, tools, products and services offered to you, the customer (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They contain important information concerning your legal rights, purchases, delivery, returns, warranties, liability and dispute resolution.

Depending on the stage of fulfilment, we may not always be able to stop an order once processing has begun.

However, this does not affect any statutory cancellation, withdrawal or return rights that may apply to you.

Returns and refunds are governed by our Worldwide Returns & Refund Policy, together with any mandatory rights available under applicable consumer law.

Unless expressly agreed otherwise, products purchased through Pawfleet are intended for personal or household use and not for commercial resale.


SECTION 4 — PRICES, TAXES AND BILLING

Prices, discounts and promotions may change without prior notice.

The price applicable to your purchase will normally be the price displayed at the time your order is submitted and confirmed.

Where applicable, taxes, delivery charges, duties or other charges will either:

  • Be included in the displayed price;

  • Be calculated at checkout; or

  • Be payable separately where clearly disclosed and permitted by applicable law.

International orders may be subject to import VAT, customs duties, taxes or charges imposed by the destination country.

Where these charges are not collected by Pawfleet at checkout, they may be collected by customs authorities, carriers or other third parties.

You agree to provide accurate and complete payment and billing information.

You represent that you are authorised to use the payment method provided for your purchase.

All payments are subject to verification and authorisation by the relevant payment provider.


SECTION 5 — SHIPPING AND DELIVERY

Delivery times shown through our Services are estimates unless expressly stated to be guaranteed.

We will make reasonable efforts to deliver orders within the estimated delivery period.

Delivery may occasionally be affected by circumstances outside our reasonable control, including:

  • Carrier disruptions

  • Customs procedures

  • Severe weather

  • Natural disasters

  • Border restrictions

  • Other events outside our reasonable control

Where a delay occurs, your statutory rights concerning delayed or failed delivery remain unaffected.

Risk of loss or damage

Where Pawfleet arranges delivery of goods to you, the risk of loss or damage remains with Pawfleet until the goods come into the physical possession of you or a person identified by you to receive them, except where applicable law provides otherwise.

If you independently appoint a carrier that was not offered by Pawfleet as a delivery option, the risk may pass to you when the goods are handed to that carrier, where permitted by applicable law.

Nothing in this section limits mandatory consumer rights relating to delivery.


SECTION 6 — RETURNS, CANCELLATIONS AND REFUNDS

Pawfleet offers a 15-calendar-day worldwide return period, subject to our Worldwide Returns & Refund Policy.

This commercial return policy is additional to any mandatory cancellation or consumer rights you may have under applicable law.

Where the law in your country, state, province or territory provides:

  • A longer mandatory return period;

  • A statutory cancellation right;

  • A legal guarantee;

  • A right to reject faulty goods;

  • A right to repair or replacement;

  • Or another mandatory remedy,

those rights will continue to apply.

Customers in jurisdictions including the United Kingdom and European Economic Area may have statutory cancellation rights for eligible online purchases independently of Pawfleet's commercial return policy.

These Terms grant you a limited, personal, non-exclusive and non-transferable right to use the Services for lawful personal purposes.

  • Create unauthorised derivative works from it.

Nothing in these Terms transfers ownership of Pawfleet's intellectual property to you.

Shopify's trademarks, names, logos and intellectual property remain the property of Shopify or its respective licensors.


SECTION 8 — OPTIONAL THIRD-PARTY TOOLS

We may provide access to optional tools, applications or functionality supplied by third parties.

We may not monitor or control these third-party tools.

Any third-party tools are made available subject to the terms imposed by the relevant third-party provider.

To the maximum extent permitted by applicable law, Pawfleet is not responsible for failures or issues caused exclusively by third-party tools outside our reasonable control.

You should review the relevant third party's terms and policies before using such services.

Nothing in this section excludes liability that cannot legally be excluded.


SECTION 9 — THIRD-PARTY LINKS

Our Services may contain links to websites, platforms or services operated by third parties.

We do not control those external services and are not responsible for their content, privacy practices, security or availability.

Accessing a third-party website is at your discretion.

Before making a purchase or providing personal information through a third-party website, you should review its:

Pawfleet uses Shopify technology to provide the Services.

However, purchases made through our store are transactions directly between you and Pawfleet, not between you and Shopify.

Shopify is not the seller of Pawfleet products.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses or damages arising solely from the sale of Pawfleet products or transactions conducted directly between Pawfleet and its customers.

Nothing in this section excludes any liability that cannot legally be excluded.

Because our Services are hosted by Shopify, Shopify may collect and process information relating to your access to and use of the Services.

This licence does not transfer ownership of your content to Pawfleet.

Where you are purchasing as a consumer, Pawfleet remains responsible for losses that are a reasonably foreseeable consequence of our breach of contract or failure to exercise legally required care.

To the maximum extent permitted by applicable law, we will not be liable for losses that are:

  • Purely indirect.

  • Not reasonably foreseeable.

  • Caused exclusively by circumstances outside our reasonable control.

  • Commercial or business losses arising where a consumer product has been used primarily for commercial or resale purposes.

Your statutory rights remain unaffected.


SECTION 19 — INDEMNIFICATION

To the extent permitted by applicable law, you may be responsible for losses reasonably incurred by Pawfleet as a direct result of your unlawful misuse of the Services or your deliberate material breach of these Terms.

Nothing in this section requires a consumer to indemnify Pawfleet for:

  • Pawfleet's own negligence.

  • Pawfleet's breach of contract.

  • Pawfleet's unlawful conduct.

  • Matters for which liability cannot legally be transferred to the consumer.


SECTION 20 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted or treated as removed to the extent necessary.

The remaining provisions will continue in effect.


SECTION 21 — WAIVER AND ENTIRE AGREEMENT

If we do not immediately exercise or enforce a right under these Terms, this does not mean that we waive that right.

These Terms, together with the policies incorporated into them, constitute the agreement governing your use of the Services and purchases made through Pawfleet, subject always to mandatory applicable law.

Nothing in this section excludes representations, information or contractual rights that applicable consumer law requires to form part of the contract.

Pawfleet is operated from Spain.

These Terms are generally governed by the laws of Spain, subject to mandatory consumer protection rules that may apply in your country of habitual residence.

Consumers

If you purchase from Pawfleet as a consumer, the choice of Spanish law in these Terms does not deprive you of any mandatory consumer protection granted to you by laws that cannot contractually be excluded.

Depending on where you live, this may include consumer protection legislation in jurisdictions such as:

  • The European Union and European Economic Area

  • The United Kingdom

  • Australia

  • Canada

  • The United States

  • Other countries, states, provinces or territories

Where mandatory local consumer law provides greater protection than these Terms, that mandatory protection will prevail.

Nothing in these Terms requires a consumer to bring a legal claim exclusively in Spain where mandatory applicable law gives the consumer the right to bring proceedings elsewhere.

Business customers

Where a purchase is made genuinely for business purposes rather than as a consumer, different legal rules may apply.

Any dispute not subject to mandatory consumer jurisdiction rules will be governed by Spanish law and submitted to the competent courts determined under applicable Spanish and international law.

MANDATORY CONSUMER RIGHTS

Nothing in these Terms of Service, our Returns & Refund Policy, Privacy Policy, Shipping Policy or any other Pawfleet policy is intended to exclude, restrict or limit statutory consumer rights that cannot legally be excluded, restricted or limited.

Where applicable mandatory law conflicts with these Terms, the mandatory law will prevail to the extent of that conflict.
